These Terms and Conditions ("Terms") govern your use of the Penslide website (penslide.com) and the Penslide software application ("Software"). By accessing the website or downloading and using the Software, you agree to be bound by these Terms. If you do not agree, please do not use our website or Software.
Penslide is operated from the United Kingdom. These Terms are governed by the laws of England and Wales.
1. Definitions
- "Penslide", "we", "us", "our" refers to the operator of penslide.com, based in the United Kingdom.
- "Software" refers to the Penslide screen annotation application distributed through this website.
- "User", "you", "your" refers to any individual or entity that accesses the website or uses the Software.
2. Use of the Software
Penslide is provided as a free screen annotation tool for personal and commercial use. You may download, install, and use the Software on any number of supported Windows or Mac devices at no charge.
Before downloading the Software, you may be asked to confirm that you accept these Terms and our Privacy Policy. If you do not accept them, you should not download or use the Software.
The desktop Software may send an anonymous startup ping so we can understand whether downloaded apps are actually opened and used. No personal data is intentionally transmitted by the app in this ping. We collect only: event name, app name, edition, app version, operating system, a SHA-256 hash of the random install ID, a SHA-256 hash of the IP address, standard user agent, and created date/time. We do not collect screenshots, drawing content, files, names, email addresses, clipboard content, exact drawing activity, what you annotate, which apps you use PenSlide over, or any content from your screen.
You may not:
- Reverse engineer, decompile, or disassemble the Software.
- Modify, adapt, or create derivative works based on the Software.
- Redistribute, sell, lease, or sublicense the Software under a different name or branding.
- Use the Software for any unlawful purpose.
- Remove or alter any proprietary notices, labels, or marks on the Software.
3. Disclaimer of Warranties
The Software is provided "as is" and "as available". You use it entirely at your own risk.
To the fullest extent permitted by law, we do not give any warranties, representations, guarantees, or conditions, whether express, implied, or statutory. This includes, without limitation:
- Any implied warranty or condition of satisfactory quality, merchantability, fitness for a particular purpose, accuracy, or non-infringement.
- Warranties that the Software will be uninterrupted, error-free, or free of viruses or other harmful components.
- Warranties regarding the accuracy, reliability, or completeness of the Software.
We make no promise that Penslide will meet your needs, work with every system, remain available, remain free from defects, or be updated in the future. You are responsible for deciding whether the Software is suitable and safe for your device, system, data, and intended use.
4. Limitation of Liability
To the maximum extent permitted by applicable law, Penslide, its owner, contributors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Software or this website.
This includes, without limitation, damages for:

- System damage, corruption, or data loss.

You acknowledge and agree that you shall not hold Penslide liable for any damage caused to your computer, data, or any other property resulting from the download, installation, or use of the Software.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under the laws of England and Wales.
5. Indemnification
You agree to indemnify, defend, and hold harmless Penslide, its owner, and contributors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Software or violation of these Terms.
6. Use at Your Own Risk
You expressly understand and agree that:
- The Software is a free tool provided without charge and without any service level agreement.
- We do not provide any technical support, maintenance, or updates as an obligation.
- Any updates or new versions are provided at our sole discretion.
- You are solely responsible for determining whether the Software is suitable for your intended use.
- You assume all risk associated with the use of the Software, including any risk to your computer systems, data, or other software.
Before using any downloaded software, you should take sensible precautions, including keeping backups of important files, using up-to-date security software, and making sure your system is suitable for the Software.
